1. Introduction

These Terms & Conditions govern the contractual relationship between tado GmbH, Sapporobogen 6-8, 80637 Munich, Germany (hereinafter referred to as the "Supplier"), and its customers (hereinafter referred to as the "Customer") regarding the Supplier's 10-year extended warranty scheme for eligible tado° X devices. By participating in this program, the Customer agrees to be bound by these Terms & Conditions.

2. Definitions

  • tado° X devices: Refers to the following tado° devices eligible for this extended warranty scheme:

- Smart Thermostat X (Wired and Wireless)

- Smart Radiator Thermostat X

- Wireless Temperature Sensor X

- Heat Pump Optimizer X

- Bridge X

- Wireless Receiver X

  • Customer: The original purchaser of an eligible tado° X device who has registered for the extended warranty.

  • Supplier: tado GmbH, the provider of the extended warranty scheme.

  • Authorized Reseller: A retailer or reseller authorized by the Supplier to sell tado° X devices.

  • Warranty Period: The total duration of the warranty coverage, which is 10 years from the original purchase date.

  • Proof of Purchase: The original sales receipt or invoice demonstrating the purchase of the eligible tado° X device from the Supplier or an Authorized Reseller.

3. Eligibility

1. The extended warranty applies exclusively to eligible tado° X devices purchased directly from the Supplier or an Authorized Reseller.

2. The extended warranty is available only to the original purchaser and is non-transferable.

3. To be eligible for the extended warranty, the Customer must register their tado° X device, providing the exact serial number, within 6 months of the original purchase date on tado.com/extended-warranty.

4. The Customer must retain and provide a copy of the Proof of Purchase to validate any warranty claims.

5. The extended warranty is valid only in the countries listed in Section 10.1 and applies to devices used in compliance with local laws and regulations.

6. The extended warranty is available for tado° X devices purchased on or before December 31, 2024.

4. Warranty Coverage

4.1 Warranty Period 
  • The standard warranty period for eligible tado° X devices is 2 years from the original purchase date.

  • Customers who register their eligible tado° X device within 6 months of the original purchase date will receive an extended warranty, bringing the total warranty period to 10 years. This extended warranty covers years 3 through 10 of the warranty period.

4.2 What is Covered

The extended warranty covers the following:

  • Manufacturing defects in materials or workmanship

  • Product malfunctions resulting from normal use

4.3 What is Not Covered

The extended warranty does not cover:

  • Damage caused by misuse, improper installation, negligence, accidents, or unauthorized repairs/modifications.

  • Cosmetic defects such as scratches, dents, normal wear and tear, or discoloration/yellowing of plastic components due to UV exposure or aging.

  • Components subject to degradation, such as tado° rechargeable batteries

  • Accessories, including but not limited to Smart Radiator Thermostat X adapter rings and USB-C cables

  • Purchases made through unauthorized resale platforms (e.g., eBay, Kleinanzeigen, Facebook Marketplace) or second-hand purchases.

  • Up to 5 dead pixels on the display. More than 5 dead pixels or the entire display being non-functional is covered.

4.4 Exclusions

The extended warranty does not apply to products:

  • Used for non-residential purposes

5. Claim Process

This section outlines the process for making a warranty claim under the extended warranty, which covers years 3 to 10 of the warranty period.

To initiate a claim during years 3 to 10, the Customer must contact tado GmbH directly, provided they have registered for the extended warranty within 6 months of the original purchase date.

To initiate a claim, the Customer must provide:

  • Proof of Purchase

  • The product’s serial number

  • A detailed description of the defect

  • Pictures and/or videos of the defect

tado GmbH may request the Customer to return the defective product for inspection.

5.1 tado GmbH's Response

If the claim is valid under the extended warranty, tado GmbH will, at its discretion, either:

  • Repair the product

  • Replace the product with a new or refurbished unit of equal or greater value

6. Limitations of Liability

  • The Supplier will not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or any damages arising from the malfunction of the tado° X device, such as increased heating/cooling costs or health-related issues.  

  • The Supplier’s liability is limited to the cost of repairing or replacing the product or the original purchase price, whichever is lower.

7. Governing Law

These Terms & Conditions and any disputes arising from them will be governed by and construed in accordance with the laws of Germany, excluding its conflict of law provisions.

8. Modification of Terms

The Supplier reserves the right to modify these Terms & Conditions at any time. Any changes will be effective immediately upon publication on the Supplier's website.

10. Supported Countries and Exclusions

10.1 Supported Countries

The Supplier provides sales, replacement, and return support for tado° X thermostats in the following countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, and the United Kingdom.  

10.2 Exclusions

The following territories are excluded from the Supplier's return and replacement policies:

  • Denmark: Faroe Islands, Greenland

  • Finland: Åland Islands

  • France: French Guiana, French Polynesia, French Southern and Antarctic Lands, Guadeloupe, La Réunion, Martinique, Mayotte, Monaco, New Caledonia, Saint-Barthélemy, Saint-Martin, Saint-Pierre and Miquelon, Wallis and Futuna

  • Germany: Büsingen, Helgoland

  • Greece: Mount Athos

  • Italy: Campione d’Italia, Livigno, San Marino, Vatican City, Italian part of Lake Lugano between Ponte Tresa and Porto Ceresio

  • Netherlands: Aruba, Bonaire, Curaçao, Saba, Sint Eustatius, Sint Maarten

  • Spain: Canary Islands, Ceuta, Melilla

  • United Kingdom: British Channel Islands, Gibraltar

11. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Force Majeure

The Supplier shall not be liable for any delay or failure to perform its obligations under these Terms & Conditions if such delay or failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, lockouts, or any other events constituting force majeure.
